This battle began with a significant victory for premium cigars on August 9, 2023, when Judge Amit Mehta ruled in favour of the CRA-led lawsuit, striking down all FDA regulations on premium cigars. This decision was a monumental win for the industry, recognizing the unique nature of premium cigars and the need to protect them from overreaching regulations.
However, the fight is far from over. The FDA has made it clear that their intention is to challenge Judge Mehta’s ruling to the Supreme Court. The FDA’s filing is the last step in this high-stakes appeals process before oral arguments begin later this year.
