FDA Withdraws Flavoured Cigar Ban Proposal: A Victory for Premium Cigar Enthusiasts

The Premium Cigar Association (PCA) has welcomed the recent decision by the Food and Drug Administration (FDA) to withdraw its proposed Tobacco Product Standard for Characterising Flavours in Cigars rule. This move ensures that adult consumers retain the ability to make informed choices without facing unnecessary prohibitions.

The FDA’s proposed rule aimed to ban flavoured cigars, including potentially extending its reach to premium cigars with “characterising flavours.” Such a regulation would have disproportionately impacted small tobacconist businesses, despite clear evidence that these products are responsibly enjoyed by adult consumers. By withdrawing the rule, the FDA has taken a step towards a more balanced regulatory approach, recognising the distinct nature of premium cigars.

Joshua Habursky, Executive Director of the PCA, expressed his gratitude, stating, “We are grateful to the Trump administration for taking swift action based on sound science and fairness, especially within the administration’s early days. Hopefully, this signals a new direction for regulatory agencies.”

The PCA has consistently maintained that premium cigars do not pose the same public health risks as other tobacco products and should not be subjected to broad, uniform regulations. This stance extends to flavoured cigars, which the PCA argues should not be unfairly prohibited. The organisation has actively opposed such prohibitions through written comments and oral briefings and remains committed to challenging similar actions at state and local levels.

This decision represents a significant victory for retailers, consumers, and manufacturers of premium cigars. It underscores the importance of science-based policymaking and a nuanced approach to regulation that respects the unique characteristics of premium cigars.
