Nine years into the legal battle over how the FDA regulates premium cigars, the fight has shifted to a deceptively simple question: what exactly qualifies as “premium”? A recent Halfwheel report breaks down the latest filings from trade groups and the FDA as Judge Amit P. Mehta considers the definition that will determine which products remain exempt from federal oversight.

At the heart of the dispute is the FDA’s current working definition, which limits “premium” status to unflavored, handmade cigars with specific construction requirements. This definition has largely kept those products out of the agency’s regulatory reach since 2020. The Cigar Association of America wants a broader standard that would include flavored cigars and some machine-assisted products, arguing that consumption patterns do not meaningfully differ.

The FDA and the other two plaintiff groups, Cigar Rights of America and the Premium Cigar Association, oppose that expansion. They warn it could open the door for mass-market products to bypass regulation entirely, undoing years of litigation and undermining public health objectives.
