Premium Cigar Industry Challenges California’s Tobacco Deadline

The premium cigar industry has taken urgent legal action against California’s Unflavoured Tobacco List (UTL)regulations. With the October 9th compliance deadline fast approaching, several leading companies and trade groups filed an emergency motion to stop enforcement.

Industry Leaders Unite for Legal Action

On October 7, 2025, Cigar Rights of America (CRA), Rocky Patel Premium Cigars, Oliva Cigar Co., Padrón Cigars, A. Fuente & Co., Ashton Distributors, La Flor Dominicana, My Father Cigars, and the Premium Cigar Association (PCA) jointly filed a Temporary Restraining Order (TRO) in a Santa Ana court.

This motion comes after the California court failed to respond to an earlier request for a preliminary injunction. The industry’s goal is clear — to prevent the enforcement of Assembly Bill 3218 and its accompanying regulations as they apply to premium cigars under federal law (21 C.F.R. § 1114.3).

Unworkable Regulations and Missed Deadlines

According to the motion, California’s Unflavoured Tobacco List imposes unrealistic deadlines and unclear compliance standards that make it impossible for companies to operate lawfully. Despite multiple attempts to work with the California Attorney General’s Office, including a recent request on October 6th to delay the deadline, the state declined to provide relief.

CRA and its co-plaintiffs argue that the new regulations are arbitrary and unworkable, posing significant harm to the premium cigar trade. Many cigar makers face operational disruption and product restrictions if the law takes effect without adjustment.

A Time-Sensitive Legal Battle

The filing, made urgently ahead of the October 9th compliance date, urges the court to act immediately. A ruling on the motion could arrive as early as tomorrow, determining whether enforcement will proceed or pause.

The case highlights the ongoing struggle between regulators and premium cigar manufacturers, who insist that artisanal, hand-rolled cigars deserve different treatment from mass-market tobacco products. The industry awaits the court’s decision as the deadline looms.
